I got the error 109 about a half hour ago myself. I just formed my LLC online on Friday, 3 days ago, and saw no warnings that I needed to wait for anything before applying for EIN. I did wait until today (Monday, Nov 15, 2021) to apply because of IRS operating hours - M-F 7am to 10pm Eastern.
Because of the one-attempt-per-24-hr rule, I will have to wait until tomorrow to try again. The only thing I'm going to do different is disable my VPN, which goes through ProtonVPN in Switzerland. It's possible the IRS doesn't like the foreign traffic (I'm physically located in U.S.).
If that doesn't work, I'll have to snail mail the EIN application using Form SS-4.
EDIT: I found it odd that the online application process didn't ask me for the name of my (single-member) LLC company. It only asked me for my SSN number, my first and last name, and the state my LLC is located in.
Please immediately do NOT engage with the collection agency! The IRS pursues debt themselves, and they levy.
This sounds like a total scam. Anyone can say they are from any company, with an ID number. And if you call back, they have a fake phone number and can answer with "IRS Debt Collection Services." You also don't want to give testimony/evidence against yourself. Have a representative represent you and pull your transcript.
Please contact an Enrolled Agent (EA) on Upwork.com and have them pull your IRS account transcript. They will be able to pull the transcript, and then, if needed, the EA is able to resolve complex tax issues.
