The key words in section 5a are “likely to cause serious injury or death”. OP’s situation is kind of a grey area. I’d make an argument that falling out of a broken chair can cause serious injury.

OP, it makes monetary, social, and ethical sense for your company to provide you a chair that is safe for you to use. This means it should at LEAST support your weight. A worker’s comp claim for your injury if you fall out of a broken chair that the company provided to you will far exceed the cost of providing an appropriate chair. The ethics behind it are obvious and you’re less likely to stick around because you’re not being treated with the respect you deserve.

I’d recommend getting HR or your EHS rep involved if you are willing to possibly make waves, but I understand how this can frustrate your boss.

I searched Amazon for some products and found a 400 capacity chair for $150. I can’t say it’s the most ergonomic chair, but at least it’ll support you for an affordable price.

I hope your boss can come to terms with reality and change his mind! Sorry you have to deal with this issue.

Most APR manufacturers will make an OV/P100 combo cartridge that would serve you best if you don’t feel like doing trial and error. This will make breathing slightly more difficult as there is an added layer of material to breathe through, but you can be sure it’ll catch the diesel vapors and “particulates”. I’ll link an example below, but it may not be the right part for your respirator. The combo will be purple and black as this one is, though.
