>“While on the surface, plaintiffs’ plain-meaning interpretation of [that section of the law] has a certain common-sense appeal, the lack of any support in the legislative history of the ACA indicates that it is not a viable theory,” U.S. District Court Judge James R. Spencer wrote in his decision out of the Eastern District of Virginia.
Seems like Humpty Dumpty legal analysis at its finest. "Pay no attention to the words in the law or what a common sense reading of those words might be! I, the life-tenured federal judge, will tell you what to know."
That's great, and I hope it happens. But we already paid for fiber everywhere at least once. The RBOCs took the money, apparently spent it all on hookers and blow they did save Christmas, I guess and didn't deploy the fiber. There were no consequences at all, so I'll save my cheering until I see it happen.
Also, ten bucks says they won't cover my mom's place because she's got incredibly shitty DSL from Verizon where she lives. It's barely better than dialup, but at least it doesn't tie up her voice line. But I guarantee you they'll count her as "served by broadband" for it, and no fiber out her road.
