If CIG loses then Star Citizen Is completely destroyed, end of story. It's a Kickstarter campaign game anyways, people are making CIG out to be worth more than they actually are, no amount of fanboy complaining, fact twisting, or fantasy will make it as anything bigger than a failed Kickstarter. It's not a triple AAA game that is supported by a real company and is basically made a year before it's even announced.

The "soft launch" already happened with 3.0. Sure none of these come to the scale and scope of what Star Citizen - hopes to be - but I ask you this... according to google at beginning of 2017 Star Citizen has currently raised 141 million...

Elite dangerous a comparable space sim took 2 years to develope. It takes an Elder Scrolls game about 4 years to develope, 2-3 years for Fallout 4... pretty much if you look into most games its 4 years... they've had about 5 and their latest release is you can now buy a plot of land... it's very obvious to me that they are making so much money just for the developement of this game that they are in no hurry to ever release it, it's not in their interest... once it's released thats it they get a last bit of cash flow from buyers of the game, probably face a huge backlash for not being as good as it promised to be, everyone plays it for about a year and then put it to history as another no mans sky-esk let down... so why release it when you can sell land or loot boxes or anything else, I think we'll still be having this conversation in 5 years time..

First off, let me give you a gold star for perhaps the best apology post I have seen. This is higher praise than you may realize.

1) Apparently, even if the other party breaches contract, you are still obligated to hold up your end. So CIG would not be off the hook just because CryTek failed them first. If that even happened, it would just be a separate case.
3) Therefore, if they were still obligated to use CryEngine, having Lumberyard and displaying their logo isn't actually a defense. They were supposed to use CE and display their logo.
4) Not as dubious as you think. Even this open, free engine LY you mention has a limit of 50 lines of code a licensee is allowed to share around publicly (57.8), and even it requires proper attribution to Amazon. It's far from a stretch that CE is even more stringent about it, lending quite a bit of weight to that particular claim.
Otherwise, damn good points made. Only recommendation I would have is to provide sources for the date claims. Pretty sure you are right about these, but it would be better with them.

Implying LY at one point had Scaleform to give, but they have merely patched it out. The burden seems to be on you to demonstrate that this ever happened. It doesn't look good according to lead mod Lavizh.
I haven't actually read this new doc, but I'm amazed to hear this is something they need to argue to begin with. The GLA has some fairly clear termination conditions, none which has been met AFAIK. It should stay in effect during the "Commercial Life of the Game", aka as long as CIG keeps selling SC to people.

Hello Games has 26 devs. They've always been a tiny team, and Murray obviously knows how to manage a tiny team well. We can see their efficiency in the high number of updates they've pushed for No Man's Sky over the past 4 years, which includes several content-heavy updates. The latest, big update - Origins - made changes to core elements of the game, and its playerbase has enjoyed the changes.
By the way, those 26 devs aren't all working on NMS; they're split between 3 separate projects. So despite the small size of the team, they're able to work on concurrent projects and reliably push new content to players.
CIG can't do that, because they're the exact opposite of Hello Games.
If, for some reason, Murray could be plucked from the working conditions he's familiar with and dropped into the bloated mess that is Cloud Imperium Games, he'd be useless at best, driven mad at worst.
The point is that the number of bugs jumps around at random depending on whether they're trying to sell ships/excuse not releasing anything. They don't go into specifics, like games in open development. Compare Subnautica's progress reports to CIGs. The fortress part is a building/management game where you try and build (and will fail in the most hilarious ways) a dwarf fortress.
All takes place in a random generated world with its own lore, monsters, heroes and actual history. Even though randomly generated it has one of the most deep lore in computer games I think.
While playing fortress mode you will make your own heroes and villains. The game really feels alive.
It is all ASCII but if you can see through that (or get one of the sprite packs) it is the deepest game I have played since 1984 and it should get way more praise than it has already.

It's well known that negativity bring much more youtube (and social media in general) attention and views than positive engagement. I think there's even a scientific paper out there saying that out-group hate is the most prolific way to go viral on the internet. The social media companies know this and they have adjusted their algorithms accordingly, creating a perverse incentive structure which rewards negativity and conflict. Most content creators sooner or later learn that instinctively. Of course, social media companies are not the ones who invented this, or are the only ones who use it. News media has been going down this path for over a decade, and they're the ones who pioneered it. It's the reason why you have partisan news networks that cater to certain sections of the political body, for example Fox News, MSNBC, etc. They've figured out that hate and fear is the best way to keep their viewers glued to the screen, and that they get much more engagement that way. There's actually a really good book about this written by a journalist, called Hate Inc., I would recommend to anyone that wants to get an introduction into the issue.
UE marketplace has mods which allow for directional gravity so that the player can easily traverse the planet. I suspect it is probably the numerous other features that will also have to be made to work correctly.
Speculation: CIG is also using the same tricks. the way the AI is confined to corridors. The AI atmosphere flight resulting in Ships clipping into the surface, The raining NPCS which seem to be trying to locate the floor of the level.
CIG arent completely incompetent otherwise the game would be stuck in around 3.0. They must still have some decent developers that are trying.

Not that long ago (2019) there were posts on /SC saying that CIG could license starengine to other companies to make more money. Forget that Crytek/amazon would not let them but its absolute dogshit LOL. Even amazon stopped using it last year for most of their studios.
I never understood why people had such problems with this. If you have legal permission to exploit a clearly defined product, then you sell off a piece of it separately, you are clearly not exploiting the same product any more. No more than if you were taking out a compound from an approved drug and selling it separately. No more than if you took out the airbags from an approved car to sell separately. No more than you can take out SQ from The Game and still call it the same game. Hopefully we agree that a court should by rights smack down anything like that.
Maybe you are right that the contract has steep criteria for violation, but there is a clear logical order here. First, the product needs to be The Game as defined, then the GLA stipulations take effect. Obviously you can't retroactively use The Game's permissions to go back and make it no longer The Game.

Well just yesterday I saw backers once again claiming CIG could license the tech the they have built for SC to other game companies for millions. To bad they dont know that CIGs broken tech for lumberyard wont matter even if they could get it to ever work as even Amazon has decided to move past lumberyard for their in house studios and canceled several LY games already in the works. If the owner of the engine dont want to use it why would any other company sign up to use it at this point? Star citizen will be the last failed LY game to be canceled in a few years.
But there is the thing like I said, it has been mentioned that it's not server a) streaming to server b), the whole icache or whatever name they use for tracking your state is what should be responsible for bridging that state into the game-server you are to now exist.

The service ends up being the load balancer, to be what works out load and decides to spin new server and split an overcrowded area of space, do the transition entities of the affected area to what is now a new game-server and call it a day.

I think they're the ones I once looked into for a friend. It's this one or another popular one I can't remember the name of you could use to take to the sky. It's not too expensive and allows you to enjoy some good games.
What it seems like to me is a movie tool being made, while the fandom allegedly gives permissions to unlimited time and money.
For the RP crowd, this FOIP would be a nice feature, for the PVP crowd it seems to have no place. As for the computer, Bored Gamer talked about a cloud service that results in not having to have anymore than a simple system getting screen shaves from the cloud service. What will be reality, I don't know, not in a high state of confidence that SC will be anything like what I understood I was buying. Just have to wait and see.
To write a thing in the ToS or EULA and to have it enforceable (at least in Europe) are 2 different things.
ToS can not rule above the law

You write a fancy new ToS that your customers don't buy cars anymore they "pledge" for expanding your "Car Imperium Garage" (Later on you found that garage is not applicable anymore and removed it from your slogan but that's a different story).
In return your customers get a car but therefore it's no sale you don't give any warranty to the car. (in germany every company has to give a warrant for a car if sold through any kind of company)
This won't be enforceable because you can not bypass consumer law just by relabeling the act of purchase. It does not matter how they call it "pledge" "donation" "wellfare" - It's a for-profit company, money has flown, product has been promised, enduser product VAT has been paid - Intention is clear - This VAT you pay is not just that your country gets richer (or less in debts) its also the guarantee that you, your purchase (money is flown) and the product is from now on under consumer protection of the country where you bought it (reminder: if you buy something online in Korea on vacation you would be under Korean consumer protection).
And a ToS often fall flat in court.
I also understand that the Americans are a little bit brainwashed regarding anti-consumer practices because the government took your consumer rights away. In Europe, Asutralia and Canada the consumer still has ways to fight for your right to ~~party~~ consume.

Yes there is no ScaleForm in LY because they never aquiered a licence for it and Autodesk is very restrictive after 2013 to give them out, there is a license to use it in Cry3 but thats all.
You have to realise that this is not a simple flash player add on it is a lightweight flash player which streams propietary neccessary data to the game client as needed.
